Press Release: PSP co-founder, Antonio Buehler no-billed on felony charge!

Four weeks after convening, the Travis County Grand Jury chose not to issue any felony indictments against Antonio Buehler or Austin Police Department (APD) Officer Patrick Oborski related to their New Year’s Day 2012 incident.

On New Year’s Day 2012, Oborski observed a car that was being driven without its headlights on West 6th street in downtown Austin, and pulled the car over at the 7-11 on N. Lamar and W. 10th Street. While Oborski was conducting a field sobriety test behind the vehicle, Norma Pizana who was a passenger in the vehicle, yelled from the passenger seat to the driver that the driver did not have to submit to a sobriety test. Oborski walked up to the car, leaned in and told Pizana not to “interfere” with his investigation, and then returned to the driver to continue the field sobriety test. However, according to the Penal Code, speech is not sufficient to “interfere” with an investigation, and Pizana was never charged with such a crime. After Pizana was told to stop attempting to communicate with the driver of the vehicle, APD Officer Robert Snider arrived on the scene and began to speak to Pizana.

Antonio Buehler, who was a designated driver that night, pulled into the same 7-11 as he was driving a friend home, in order to refuel the truck he was driving. When he finished fueling up, Buehler and his passenger, Ben Munoz, began to get back into their truck when they heard Pizana scream violently. They turned and saw Snider violently pulling Pizana out of the vehicle, and then throwing her down on the ground. As Pizana continued to cry out in pain, Oborski joined in and they began to apply continued upward pressure on her arms in what is considered a torture move by the U.S. Military and Federal Government. At that moment, Buehler tried to take pictures of what he believed was a violent assault. When Pizana noticed him taking pictures, she begged him to record the incident, and Buehler then began to demand that the cops stop abusing Pizana. Although Pizana was seated in her car, was not a threat to herself or the public, and her driver had not yet been arrested, she was arrested for Public Intoxication, a Class C misdemeanor.

El neoliberalismo no es sólo una ideología que defienda la retirada del Estado, su desmantelamiento a favor del mercado, o un dejar hacer a la “mano invisible” del capitalismo financiero. Tal como ya lo ha demostrado Michel Foucault, en “ el nacimiento de la biopolítica”, y actualmente Christian Laval y Pierre Dardot, el neoliberalismo, a diferencia del liberalismo clásico o el neoconservadurismo, es una construcción positiva, que se apropia no sólo del orden del Estado, sino que es un permanente productor de reglas institucionales, jurídicas y normativas, que dan forma a un nuevo tipo de “racionalidad” dominante. Esta racionalidad actualmente se ha adueñado de todo el tejido institucional de la llamada Unión Europea, en la consumación final de su estrategia de dominación. El neoliberalismo no es sólo una máquina destructora de reglas, si bien socava los lazos sociales, a su vez su racionalidad se propone organizar una nueva relación entre los gobernantes y los gobernados, una “gubernamentabilidad” según el principio universal de la competencia y la maximización del rendimiento extendida a todas la esferas públicas, reordenándolas y atravesándolas con nuevos dispositivos de control y evaluación: como insistió Foucault, explicando la génesis del neoliberalismo, es la propia población la que pasa a ser objeto del saber y el poder.

INDECT For the Security of Citizens

INDECT ist das Akronym des EU-Forschungsprojektes Intelligent information system supporting observation, searching and detection for security of citizens in urban environment (engl.; auf deutsch: Intelligentes Informationssystem zur Unterstützung von Überwachung, Suche und Erfassung für die Sicherheit von Bürgern in städtischer Umgebung), eines von der Europäischen Union im Rahmen des 7. Forschungsrahmenprogramms finanzierten Vorhabens im Bereich der „intelligenten Sicherheitssysteme“.[1] Es startete 2009 und soll fünf Jahre laufen.

Einen charakteristischen Teil der „Testinstallation“, die im Rahmen des Forschungsprojekts entwickelt werden soll, bildet die umfassende Videoüberwachung des öffentlichen Raums. Dabei sollen Computer in den Bildern von Überwachungskameras und von fliegenden Kamera-Drohnen vollautomatisch „abnormal“ handelnde Menschen erkennen können, und so einen Beitrag zur vorbeugenden Kriminalitätsbekämpfung leisten. Das Projekt wird wegen seines umfassenden Überwachungscharakters von vielen Seiten massiv kritisiert. Unter anderem ist auch die Einbeziehung von Personendaten aussozialen Netzwerken und von Mobiltelefon-Ortungsdaten vorgesehen.

Der dystopische Roman 1984des britischen SchriftstellersGeorge Orwell – der von einem allmächtigen Überwachungsstaat mit allgegenwärtigen Kameras handelt – wird von Kritikern des Projekts häufig zitiert. So bezeichnete der britische Daily Telegraph das Projekt 2009 alsOrwellschen Plan.[14] Der Freitagfragte mit Bezug auf die INDECT-Projektziele rhetorisch, ob Orwell wohl ein „naiver Optimist“ war.[15]

Ethical Issues

The sentence: “if you have done nothing wrong, you have nothing to fear” is only true if every aspect of the criminal justice system works perfectly, on every occasion. Tools based on INDECT project research outcomes will provide EU Member States with the technology to ensure that decisions around public safety are based on the maximum amount of relevant information available.
